1. Agreement

By registering your school on Clurk, you ("the School") agree to these Terms of Service with [Your Name], operating as Clurk ("we", "us", "our"). If you do not agree, do not use the platform.

2. What Clurk Provides

Clurk provides a cloud-based attendance tracking platform that allows schools to:

• Manage classes, students, and teachers
• Record and track daily attendance
• Send WhatsApp absence notifications to parents
• Download monthly attendance reports in Excel format

We reserve the right to add, modify, or remove features at any time with reasonable notice.

3. Payment

• Access to Clurk requires a valid subscription.
• Invoices are due within [X] days of issue.
• Failure to pay within [X] days will result in suspension of access.
• Suspended accounts will be terminated and data deleted after 30 days of non-payment.
• We reserve the right to revise pricing with 30 days written notice to the school's registered email.

4. Data Loss

We maintain redundant backups across two independent cloud providers to minimize the risk of data loss. However:

• Clurk does not guarantee zero data loss under all circumstances.
• In the event of data loss, our maximum liability is limited to restoring the most recent available backup.
• We are not liable for any indirect, consequential, or financial losses arising from data loss.
• The school is responsible for downloading and maintaining their own copies of attendance records via the Excel export feature.

5. Downtime and Availability

• Clurk does not guarantee 100% uptime.
• We will make reasonable efforts to notify schools of planned maintenance in advance.
• We are not liable for any losses or disruptions arising from platform unavailability, including during examinations or reporting periods.

6. Account Security

• The school is solely responsible for maintaining the confidentiality of admin account credentials.
• Teachers are responsible for maintaining the confidentiality of their own login credentials.
• Any activity that occurs under a school's or teacher's account is the sole responsibility of that account holder.
• Clurk is not liable for any unauthorized access or damage resulting from leaked or compromised credentials.
• If you suspect unauthorized access, notify us immediately at [your email].

7. Acceptable Use

The school agrees to:

• Use Clurk solely for legitimate attendance tracking purposes.
• Enter accurate and lawful data into the platform.
• Not attempt to reverse engineer, copy, or replicate Clurk's software or functionality.
• Not share admin access with unauthorized individuals outside the school's administration.
• Not use Clurk for any unlawful purpose.

Violation of this section may result in immediate termination without refund.

8. Teacher Misconduct

The school is solely responsible for the actions of teachers using the platform, including any incorrect, fraudulent, or malicious attendance data entered by teachers. Clurk is not liable for any consequences arising from teacher misconduct on the platform.

9. Intellectual Property

All software, design, code, branding, and content of Clurk is the exclusive intellectual property of [Your Name] / Clurk. The school is granted a limited, non-transferable, non-exclusive license to use the platform for internal attendance tracking purposes only.

10. Termination

• By the school: The school may terminate their subscription at any time by notifying us at [your email]. Data will be deleted within 30 days.
• By Clurk: We reserve the right to terminate any account that violates these terms, with or without prior notice depending on severity.
• If Clurk shuts down: We will provide a minimum of 30 days written notice to all active schools. All data will be permanently deleted after the shutdown date.

11. Limitation of Liability

• Clurk's total liability shall not exceed the amount paid by the school in the 3 months preceding the claim.
• Clurk is not liable for any indirect, incidental, consequential, or punitive damages of any kind.

12. Changes to These Terms

We reserve the right to update these Terms of Service. Material changes will be communicated to the school's registered email at least 14 days before taking effect. Continued use of Clurk after that date constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.

1. Who We Are

Clurk is an attendance tracking platform for schools, operated by Anantha Krishna N, Founder, Clurk. For any queries, please contact us at [your email].

2. This Policy Applies To

• Schools and their administrators using Clurk
• Teachers who access Clurk through their school
• Parents whose phone numbers are provided by the school for receiving notifications

3. Data We Collect

Directly from schools:

• School name, phone number, email address
• Teacher names and login credentials
• Student names and class/section
• Parent/guardian phone numbers

Indirectly:

• IP addresses and request timestamps (server logs via Railway)
• Browser and device information (server logs)
• Session tokens for authentication

We do not collect: student photographs, Aadhaar or any government ID, or any financial information.

4. Why We Collect This Data

We collect and process data solely for providing the service, sending absence notifications to parents through WhatsApp, maintaining platform security, and generating attendance excel reports for schools.

We do not sell or use your data for advertising.

5. Data of Minors

Clurk processes the names and attendance records of students, who may be minors (under 18 years of age). Under the Digital Personal Data Protection Act, 2023 (DPDP Act), the school is the Data Fiduciary and is solely responsible for obtaining verifiable parental consent before submitting student data to Clurk.

6. How We Share Your Data

We do not share your data with third parties except the following sub-processors, who we use and are necessary to operate the service:

7. Cookies and Local Storage

Clurk uses httponly cookies to store authentication session tokens. These cookies are not accessible via JavaScript, are used solely for keeping you logged in, are not used for tracking or advertising, and expire within 7 days for remembered sessions.

8. Data Retention

We retain your data for the duration of your contract with Clurk. Upon termination, all school, teacher, student, and attendance data will be permanently deleted within 30 days. Server logs are retained for up to 90 days for security purposes. You may request early deletion by contacting us at [your email].

9. Data Security

• Passwords stored using industry-standard hashing (never plain text)
• Authentication via secure httponly cookies
• All data transmitted over HTTPS
• Encrypted backups on Backblaze B2
• Access to production database restricted to authorized personnel only

10. Your Rights (DPDP Act 2023)

As a data principal, you have the right to access, correct, or request deletion of your personal data, withdraw consent for processing, and nominate someone to exercise these rights on your behalf.
